Terms & Conditions 

Introduction 

Vandango Limited, your premier camper rental service on the picturesque Isle of Man. We are excited to be your travel partner for unforgettable adventures. Before you embark on your journey, please take a moment to review and understand our terms and conditions. A breach of any of these terms, depending on the nature of the breach, may give rise to; the loss of security deposit, invalid insurance cover, a criminal offence being committed. By renting a camper from us, you agree to abide by the following terms.


Definitions

'You/Your/Yours': Refers to the hirer of the vehicle as recorded on the agreement, and any additional drivers also recorded on the agreement.


'We/Our/Us’: Refers to Vandango Limited and its employees and agents.


'Vandango Limited': Vandango Limited is the legal entity providing camper rental services, registered on the Isle of Man under company number: 136247C, with its registered address at 7 School Road, Onchan, Isle of Man IM3 4LX.


'Hirer': Refers to the person or persons nominated as the hirer under the


'Hirers Name / Contact' section on the Rental Agreement. It also includes any person whose credit or debit card is presented for payment of the rental charges. Furthermore, it encompasses any person who considers themselves to be the legal entity responsible for the rented campervan. If the legal entity differs from the driver, full name, address, and contact phone numbers must be provided.


‘Agreement': This term refers to the Rental Agreement, the Insurance Motor Rental Agreement, and these Terms and Conditions collectively. In the event of any discrepancy between these Terms and Conditions and any other literature provided by Vandango Limited, the provisions of these Terms and Conditions take precedence.


'Rental Period': means the duration of the campervan hire as stated on the Rental Agreement or any mutually agreed variation. It also includes any additional period during which the campervan remains in the hirer's possession or control.


'Vehicle': Refers to the vehicle provided to you by us in accordance with the terms of the agreement.


'Accessories': Refers to any supplemental and/or additional item provided by us to you as part of the hire of the vehicle according to the terms of this agreement, that nonetheless does not form part of the vehicle itself.


'Security Deposit': The 'Security Deposit' denotes the amount held as security by Vandango Limited in connection with this camper rental.


'Damage': Refers to any loss or defect that arises while the vehicle is in your care, whether cosmetic, electrical, or mechanical, that causes the vehicle to no longer be in the same condition as it was when we provided it to you.


 

1. Collection & return of the camper

1.1.          You must collect the vehicle between 3pm and 5pm at the pre confirmed collection point, confirmation of the location will be confirmed by us with you 1 week before your arrival date. Allow for a half an hour hand-over on collection to demonstrate the working of the vehicle and all the accessories on board. All drivers must be present on collection with their relevant documentation. Confirmed in sections 2.

1.2.          You must return the vehicle on the correct date before 11am at the confirmed drop off location, confirmation of the location will be confirmed by us with you 1 week before your arrival date. Allow for a half an hour hand-over on drop off. Vehicles must be returned undamaged, with a full tank of diesel, empty wastewater, and toilet cassette and the interior clean and in the same condition as when collected, otherwise a charge will be made for additional valeting and or upholstery cleaning.

1.3.          Late returns, you must notify Vandango Limited immediately. Failure to do so will mean you will be driving the vehicle uninsured and result in prosecution. You will be charged at £100 per hour for returning the vehicle past the return time.

 

2. Hire of the vehicle

2.1.          All drivers must be aged between 25 and 79 years old and have held a full valid driver's licence for two years. We will offer the vehicle for hire to 23 or 24 years, if all details have been passed to the insurer and they have approved the driver to hire the vehicle in advance. We reserve the right to refuse the hire of a vehicle to any driver we see fit without explanation.

2.2.          Details of any additional drivers will be required at least 1 week before the collection date of the vehicle.

2.3.          Insurance claims: You must declare at the time of booking if you have made or had vehicle insurance claim made against you within the last 3 years. Vandango Limited may not be able to get cover should you have had 2 or more claims within the last 3 years.

2.4.          All drivers of the vehicle cannot have had their licence suspended for any period within the last three years, or obtained a BA, DD, or UT conviction.

2.5.          Should the vehicle have been involved in an accident involving damage to itself or third-party property, you will be liable for the policy excess shown below:

2.6.          All drivers must provide valid drivers' licence, as well as a valid passport on collection of the vehicle.

2.7.          If you have a Manx licence or any licence outside of the UK, we will need written confirmation of any claims that have occurred within the last 5 years.

2.8.          If you have a photocard GB licence, we require the photocard and your NI (National Insurance) number to check your licence details on the DVLA’s online system. We are unable to insure you if we have not DVLA checked your licence details.

2.9.          Each driver will need to provide two forms of proof of address from separate sources, all documents must be dated within 90 days, or an Annual Tax bill will be accepted.

2.10.       Licence outside of the following licence types, UK, EU, AU, & NZ, will need to be referred in advance.

2.11.       Drivers are personally liable for all legal penalties (e.g.: parking tickets, congestion charges, speeding fines) which are incurred during the period of hire.

2.12.       We will be able to cover USA/CAN/SA licence holders provided they have previous UK driving experience, as displayed below

3. Use of the vehicle

3.1.          I agree that during the rental period, I will not and will not allow the Vehicle to be

·                Driven in an unsafe, reckless, or dangerous manner

·                Driven off the road or on unsafe road surface

·                Used in a manner which could cause damage to the vehicle, its passengers or third parties or their property

·                Driven by a person in any way under the influence of alcohol or drugs, or with a blood alcohol level above the legal limit

·                Driven by any person not authorised by us to do so

·                Driven by any person under the age of 25 or over the age of 79 (unless otherwise agreed by the Insurer)

·                Driven by any person not legally entitled to drive a motor vehicle

·                Driven by any person not legally entitled to drive a motor vehicle of this type

·                Driven by any person not in possession of a full valid driving licence

·                Left unoccupied with any of the keys in or on the vehicle

·                Left unoccupied without the steering lock in place

·                Submerged in water, or put into contact with salt water

·                Used for any illegal purpose, or for any race, rally, or contest

·                Used to tow any other vehicle and/or trailer

·                Used to carry passengers/property for hire and reward

·                Used to carry more passengers/property than is permitted by the specific hire agreement entered

·                Used to carry volatile material (including but not limited to liquids, gases, explosives, or corrosives)

·                Used in any way that would breach your obligations under the hire agreement

·                Permit smoking in or near the campervan

·                Lent or hired the campervan to a third party

·                Used to carry more passengers than the permitted capacity of the camper van

·                Moved without the written consent of Vandango Limited out of the permitted zone of the Isle of Man and the United Kingdom.

·                Driven on nonstandard roads or in extreme weather conditions as defined by the hire company

 

4. Smoking in the vehicle

Smoking of any kind is banned in or near our vehicles. There will be a deduction from your security deposit should there be evidence of smoking having taken place within the vehicle upon its return to us.


5. Road restrictions

5.1.          The vehicle should only be driven on tarmac/sealed roads and should not be taken off road. Driven on campsite fields is acceptable, take caution not to get the vehicle stuck.

5.2.          You acknowledge Vandango Limited reserves the right at any time, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause

 

6. Taking pets

6.1.          Should you wish to bring your pet along this will need to be confirmed by us in advance. We reserve the right to refuse to allow your pet or pets at our own discretion and without explanation.

6.2.          Should your pet cause damage to the vehicle's interior and/or accessories, the cost of rectification will be deducted from your security deposit in the first instance.

 

7. Title to Vehicle

You acknowledge that Vandango Limited retains title to the vehicle and its contents and that you possess the goods as a mere bailee only. You do not have any right to pledge Vandango Limited’s credit in connection with the vehicle and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or the Vehicle.

 

8. Passengers in vehicle

We authorise the use of the vehicle up to the stated number of passengers. Each person is to always use the seatbelts whilst the vehicle is in motion. Child seats are available (fees applicable), and it is the responsibility of the hirer to fit them themselves. Children up to 12 years of age or 135cm in height, which ever they reach first, must use the correct child restraints appropriate for their weight under Manx/UK law.

 

9. Modification to the vehicle

You will not make any modifications of any kind to the vehicle's exterior, interior, mechanical or electrical workings or accessories without our prior consent.

 

10. Maintenance of the vehicle

10.1.       You will ensure that the vehicle is properly maintained while in your care, within a reasonable limit. This is to include checking oil and water levels daily and ensuring that the vehicle's tyres are safe before moving off

10.2.       Regular checks of the battery are also essential. Do not continue to run the battery for an extended period to run electrical equipment or accessories

 

11. Making payment

11.1.       You must confirm the availability of the vehicle with us at the time of booking. A booking is only fully confirmed once a non-returnable booking deposit of £150.00 has been received, at which point your confirmation email will be sent. The balance of the hire charges must then be paid at least 6 weeks before hire commences.

11.2.       Should booking occur within 6 weeks of the date that hire is due to commence, the full hire charges will be payable immediately upon booking, and upon receipt the confirmation email will be sent.

11.3.       Payment of the hire charges is debit card, credit card, PayPal, or bank transfer. Only one discount code/voucher code can be used per booking.

11.4.       Yearly events on the Island such as dates for the TT fortnight & MGP, depending on when booked we may ask the balance to either be paid upfront in full, or with a booking deposit and the balance cleared in a set number of months before the hire commences. This will be confirmed by us with you before the booking is confirmed. Failure to clear the balance before the confirmed date, may risk cancellation of your booking, and loss of monies paid toward the balance such as booking deposits or partial payments.

 

12. Cancellations & charges

12.1.       Should you be forced to cancel your booking prior to 6 weeks before hire commences, you will lose the non-refundable £150.00 booking deposit.

12.2.        Should cancellation occur within 6 weeks of the date that hire is due to commence, you will lose the full amount of the hire charges.

12.3.       Gift Vouchers are non-refundable including any unspent sums.

12.4.       If your hire cannot proceed because of legal government restrictions such as a local or national lockdown where overnight stays away from your primary residence are not permitted, then we will offer a change of date where the full value of your booking can be transferred to a new date. If preferred alternative dates are not yet known, then we will issue a gift voucher code to the full value paid that will have no expiry date on use or restriction on use so that you can rebook your trip at your leisure

12.5.       Bookings for yearly events on the Island such as dates for the TT fortnight & MGP, the full balance is non-refundable within 16 weeks of the hire date taking place.

 

13. Security deposit

13.1.       A security deposit of £500 is payable before hire can commence. This deposit is fully refundable upon the return of the vehicle, provided it and any accessories are delivered on time and in the same condition as when they left. This must include a full tank of the correct fuel type.

13.2.       We may ask for a larger security deposit for bookings during hire periods that take place during busy events on island such as the TT fortnight or MGP, or if you are taking the campervan off the island, or if the insurance confirms your excess for claims is higher. The amount will be confirmed by us with you prior to confirming your booking.

13.3.       The deposit will be refunded to you within 7 days of these conditions being met.

13.4.       You will be charged if the vehicle is returned past the agreed time, at £100.00 per hour.

13.5.       Should any damage to the interior of the vehicle and/or the accessories exceed the security deposit, you will be liable for settling these additional costs.

13.6.       If you are in an accident and the vehicle or another vehicle is damaged due to your error and we must make a claim through the insurance, you will be liable for paying the excess of £1000, which will come from the security deposit and then the additional payment must be paid by yourself. If the insurance company advises the excess for any driver during your period is higher than the £1000 you will be liable for the full amount of excess confirmed prior to the rental.

13.7.       Should the damage not exceed the security deposit then we will only charge you for the amount required to set right the damage and will return the remainder of the deposit to you.

 

14. Vehicle insurance

14.1.       Comprehensive insurance cover is included in the stated price, with a standard excess of £1000 payable in the event of any accident damage to either the vehicle or third-party property. You will be liable for this excess, as well as for the replacement or repair involved in any damage to the windscreen (£500 excess for replacement) or tyres.

14.2.       The driver, or drivers, must be between the ages of 25 – 79 years old for them to be covered, and therefore will not allow any additional driver below this age 25 or older than 79. Unless confirmed by insurance company prior to the booking.

14.3.       Repair costs which are less than the Insurance Excess will be invoiced directly to the Hirer. An insurance claim will only be made if the total repair cost exceeds £1000

14.4.       Hirers cannot be insured in the following circumstances:

·                Are under 25 or over 79 years of age unless otherwise agreed by the Insurer.

·       Not held a full UK or EU licence for 24 months.

·       Has not had their licence suspended for any period in the last 3 years

·       Has not been involved in more than one fault incident within the last 3 years

·       Has no more than 2 convictions with a maximum of 3 points per conviction. unless otherwise agreed by the Insurer.

·       Has not obtained a BA, DD, or UT conviction.

·       Persons who have any mental or physical defect or infirmity or suffers from fits, diabetes, or any heart complaint.

·       Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed because of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer.

·       Used to carry passengers/property for hire and reward

·       Used for the carriage of goods of an explosive, dangerous or hazardous nature.

 

15. Vehicle insurance

The following are not covered by VW Camper Hire's Vehicle Insurance:

·       Windscreen, glass & tyre damage

·       Minor damage to exterior vehicle paintwork, and with total repair costs less than £1000

·       Loss/damage/theft to the radio, stereo equipment, and aerials

·       Personal effects within or from the vehicle

·       Interior damage including burns, to seats, flooring and living or cooking equipment

·       Any equipment on hire

·       Any consequential expenses or additional costs incurred in hiring alternative vehicles

·       Missed transport, accommodation, travel expenses or any third-party claims in connection with a breakdown or accident

·       You shall be liable to pay the full cost of repair of any damage which the campervan may suffer as the result of accidental damage, or wilful or negligent action of the Hirer

 

16. Cleaning

16.1.       As part of the hire agreement, you are expected to sweep out any debris in the campervan, wipe down all internal surfaces before returning the vehicle, cleaned any used utensils and accessories.

16.2.       You also agree to bring the camper van back in a condition that is not unreasonably dirty on the outside.

 

17. Responsibility when accidents occur

17.1.       Should an accident occur while the vehicle is in your care, or should any accident, loss or damage occur to the vehicle, you must inform us within 24 hours

17.2.       Any theft, road traffic accident or damage to third party property arising out of your use of the vehicle must be reported by you to the local police. Names, addresses, and contact telephone numbers for all third parties and witnesses must be obtained by you, even if the matter is straightforward and/or the damage minimal.

17.3.       By signing the agreement, you undertake to assist us and our representatives in handling any claim arising from any accident, incident or event occurring while the vehicle is in your care, including but not limited to the completion of report forms and witness statements, interview by our representatives or their agents and attending Court to provide evidence.

 

18. Breakdown and recovery

In the event of a breakdown rendering the vehicle immobile, you must immediately telephone us in order that we can instruct our nominated breakdown service to arrange for recovery


19. Ending the hire agreement

We reserve the right to end the agreement and take back the vehicle from you at any time, for any reason and without notice. Such reasons include but not limited to the following:

·       If any part of the agreement or these terms & conditions is found to have been breached by, you

·       If you are found to have misrepresented yourself or your circumstances in providing information to us relating to the hire, deliberately or in ignorance of the facts

·       If the vehicle is discovered abandoned

·       If the vehicle is not returned to us on the agreed date or we have reasonable cause to believe that it will not be returned on the agreed date

·       If we consider that there is reasonable cause to believe that the vehicle is being used in an unsafe or dangerous manner

Should this agreement be ended prematurely in such a fashion and/or for such a reason, you will be entitled to no refund of any part of the hire charges or security deposit from us.


20. Changes

Any changes to this agreement must be in writing and must be signed on behalf of Vandango Limited and by you.


21. Your warranties

You warrant that all information supplied by you to Vandango Limited in connection with this agreement is true.


22. Data protection act

The information that you have provided to Vandango Limited will be used to fulfil this contract placed with us. We will not pass this information onto any other organisation outside this company other than to our insurer.


23. Governing Law

The Hire Agreement and these terms and conditions shall be governed by the law of the Isle of Man in which the agreement was signed.
